"Hi. I’m Steve Kramer of the Kramer Law Firm. I am a Florida family law and divorce attorney. And today’s topic on family law and divorce is mandatory disclosure. What is mandatory disclosure? What you need to know is that in a divorce case you and your spouse are required to serve each other copies of financial documents. Important financial information and financial affidavits, which is a breakdown of basically your incomes, expenses, assets, and debts. Now these documents include paystubs, bank statements, credit cards, 401k documentation, other retirement documentation, deeds, titles to cars, leases - anything that shows value, assets, whatever. You’ve got to turn all that over to your spouse. And the same applies if you’re having a paternity action. And it’s really designed so that each of you have full disclosure of what’s going on.

Now if you’ve got an attorney – or your spouse has an attorney – they may also request documents above and beyond the minimum set forth by mandatory disclosure. But these documents are going to have a big impact on your case and they’re also going to tell you what’s going on with your spouse; what their financial position is and it’s going to enable your attorney to come up with things like child support, figuring out how to divide up your assets and debts, and basically alimony, and basically coming to a resolution in your case or knowing where we stand. So that if we have to go to trial or mediation – which is again, mediation is where each of the parties come into a room with a mediator and try to resolve the differences themselves – so that we can be prepared and give you good advice.

I’m telling you this because I want to make sure you’ve got good advice. I want to make sure you understand that if you ever wind up in a divorce or a paternity action, you’re entitled to these documents. These documents and the disclosure is designed to protect you.
